Question My hosting was suspended! Help!

I have a website buynick.biz, hosted with neosurge.com that has an opt-in email list. I contacted them 2 years ago prior to hosting with them to make sure they were cool with me having this listserv on their hosting. They told me yes. They even helped me set it up. Two weeks ago they suspended my site because I was taking up too much bandwith during an email being sent to the listserv. Now they won't reinstate my hosting account and I've lost some of the data from the opt-in list.

Question is, how can I get the information from them? How can I get them to reinstate my account? Do I have any legal standing in forcing them to give me my data?

Obviously, I've asked nicely several times and told them I just need access for a day, and am happy to put stricter sending limits to reduce my bandwith usage.
    Sincerely,

You should look into getting a VPS. That way no one can tell you what you can do with it.

As for your current troubles. You will have little luck using legal channels against them as I'm sure their TOS has covered them.

In order to keep you as a customer, they should have already given you your data. Often what happens when a customer is canceled; they will erase your data and then when you come looking for something they choose to say nothing instead of saying "oh we erased all your data".

Again if this email list is bringing in any money I would recommend investing in a VPS server.

Let me know if I can help,
