I know a lot of designs, graphics/prints, stitching, etc...are trademarked and/or copyrighted and in order to use those you need permission. I remember, not long ago, that a jeans company was being sued because they used that same stitching pattern as a rival company.

Creating your own designs is best. My friends friend, I have never met the guy, has his own t-shirt design company here in L.A., where he creates and prints the shirts at home and sells them by the dozen to local surf shops, skate shops, etc...He does it all out of his garage.

If you are not an artist, team up with someone who is, make it legal and sign a contract written up by a lawyer which clearly stats who owns what and who each is bringing to the company.

It can be done, but it won't be easy and if it is easy then your not doing it right.
