It appears this is simply an advertising affiliate position which does not have anything to do with producing or selling content, the company is responsible for this, not affiliates who advertise site.

As to being first, I research them all, and this is the first time I have seen an affiliate multi tier compensation plan, most are basic affiliate single tier which have been online for years, so I suspect this would fall under the same advertising, not producing or selling content, just advertising it.

Correct, they are advertising for people to become involved in the adult industry. They appeal to them monetarily, however like any other business it takes a long time (if ever) to build up to that tier and those who get involved in this business should know all the ins and outs of the legalities they are exposed to.
