    have a chat with dfveteren, she was looking at something similar and was checking out the legalities of using ebay in domains, because I have heard a lot of stories of them shutting down even small time operators.

    The name should be fine, when corporations start "shutting you down" for having a word that may contain their logo as a sub word.... That's when the world's ending :P.

    If you want to try to avoid being shut down, you need to make it very clear to customers that you are in no way affiliated with eBay. This should be open and obvious to them (think large, bright letters in the heading of your website). The law of trademarks is concerned with whether a normal person would confuse two companies or names, either with each other or as being associated. I would not pay for it because I wouldn't want to take that chance, but that's just me.
