When is it Legal or Illegal!?

hi everyone, i have a simple question, when do i know if importing goods from china to canada is legal or not!?

number1: I mean, i know that buying nike, adidas, puma jerseys replicas its illegal, because its a replica of nike adidas or umbro authentic jerseys!!!! but even if its illegal, do you have good chances to get caught, and if yes, what could happen!?

number2: is it illegal as well if i sell tooth brush, batteries, toys and stuff that are just chinese and not really a replica of fisher price, duracell, colgate etc.... if its not illegal, can i resell them on the marker, to friends, and even on ebay or in a friends shop!? I would really like to know , and if its illegal, what should i do, to make it legal!! me!

The legality is pretty simple. You can't sell other peoples brands unless you are authorized to do so. You can't sell a patented product unless you are paying for the patent rights.

Most products imported from China and sold online are not branded products. Items like birdhouses and mailboxes are great online products.

But every product have a brand no ? those chinese products have a name or a brand non ? whats make them legal to sell online or in real life! ?

and how to have an autorizathion to sell products for nike or maxell or wtver?

So if i understand well, if i order like some keychans or a cheap brand like chining or something like that, i buy it from wholesale webiste. i could resell them legaly with even putting adds on walls or stuff like that!?
it would be 100 % legal?

This isn't going to help you at all, but I'll throw it out there anyway.

If someone else is the owner of some intellectual property (copyright, patent, or trademark), you are not legally permitted to use that property without the owner's permission. (There are a few exceptions, but we aren't dealing with those in this case.)

Whether it's the use of a few paragraphs out of a magazine article in your blog (copyright), the reproduction of a new, unique tool (patent), or the placement of a Nike Swoosh on a tee shirt that you have manufactured in China (trademark), you're violating intellectual property law.

If there's any question about these, consult an attorney.

but if i buy something original, like panassonic batteries, can i resell them without problems? Because even in s tore they dont by directly from panassonic, they buy from wholesale simply! like i wanna do !

Including with the above comments, you may also encounter the issue of importing grey market goods.

Unless you agreed at the time of purchase that the item you were purchasing is non-transferable, then I don't know why you couldn't sell something that you now own.
