    Producer / Secondary...and not

    I have a serious dilemma. My website is designed around users submitting embedded videos they find on the net of girls shaking their booty, my 2257 reads that if they need the documents to kindly ask the person hosting the actual content because I am simply a portal to their content...

    Here is the dilemma....thats all gravy accept that I would love to add a members section with only my own videos that I paid for through adult content providing websites that equip all the videos with 2257 and release forms...so the problem is that this would automatically put me into the category if a secondary producer? while my main site is neither...

    Question: Can I make a hybrid 2257 form addressing the public section of the site as embedded content and the private members area of the site to have all proper 2257 forms on file with me...

    If any lawyers can help draft something of this nature we can discuss price.

    The only thing I can recommend is having your website reviewed by an attorney who is versed in Adult Entertainment Law. What you are/are not responsible for may depend on the "social networking" status of your site (in regards to your user submitted content). When you purchase content and use that content on your own website then yes, you are considered a secondary producer and are therefore responsible for getting the proper 2257 documents from the person/company you purchase the content from.

    That being said, you are then responsible for maintaining those records for a minimum of 20 business hours in an office setting "supervised" and would need to have a compliance statement on your website stating who is and where you are having your records stored.
