    Legal Protection for Uploading Images

    Hi All:

    I am developing an online business that allows both registered (and unregistered) users to upload their images to the application.

    I know that there are a great deal of legal ramifications that relate to images and photographic content; therefore, I would really appreciate any legal advice -- or how to acquire legal advice -- as it pertains to this area.

    err..very good question

    the quick answer is "do what facebook/flickr.com doe and put in a disclaimer shifting liability to user"

    the proper answer is long and complicated..you'd really need to see what's called an "entertainment lawyer", who will help you set an appropriate legal structure for your business, draft a solid TOS and think through the insurance issues..you don't wanna be like that poor lady who got done for piracy

    Wilson & Sonsini are the premier firm for this kind of work..they would have articles published on their site to cover "copyright liability for user generated content websites"
