    Legal Advice

    Hello, I’d like to begin my own company (California) within the travel industry. It's entertainment travel and I have plenty of experience. My only issue is I’m afraid of getting sued! I've met with a lawyer, but I’m still skeptical. I quit my past employer and would like to throw my own trip and begin my own company. What are the odds of my old company “actually" suing me? Any advice would be GREAT!

    If you don't have to sign a non-compete agreement (common practice in the investment industry among others, not sure about the travel) then you should be fine, unless you're using some sort of proprietary platform or something. I wouldn't tell them you're leaving to found a competing company, just say you're pursuing other ventures...

    just like eich41 said, if there was no non-competition agreement when you were employed by your past employer, then they shouldn't have any grounds for coming after you. The only things you might want to be careful about is any business practices that they used and might have intellectual property rights to. You might want to look at copies of your employment paperwork to see if there was any such clause in them.

    Jeffrey Cohen of Internet Litigators is based out in Los Angeles and can help you out. This way you have established a relationship with an attorney who can help you out if the need arises.

    Depending on the state, some non-compete clauses are not worth the paper they are written on.
