    Follow Up Questions

    I have a couple questions, was hoping you could help.
    1) Are there specific lawyers to speak to about eCommerce websites?
    2) Are there specific insurance plans for eCommerce websites?
    3) If a profit-generating website referred to and used someone's name on the site without their knowledge, can this be construed as negative and grounds to sue?

    1. Copyright is automatic. If you create original work, nobody can copy it or publish it without your consent. You'd want to do it formally if you want to have it dated so that you can positively prove that the work is yours because you have the oldest dated version. Don't bother, just print it and the print-out will have a date.

    2. There are insurance companies that specialize in internet businesses. Call a few brokers because not all have access to these insurance companies. They will ask some specific questions like how much revenue you generate in your home country, how much revenue from other countries, what you do to keep your data safe, how you plan to deal with cyber attacks. There are very few insurance companies that will write internet liability policies. Insurance is an old school industry; not very innovative. So, if they don't understand the business, they won't insure it.

    3. Why would you want to sue someone that uses your name anyways? Most of the time when you are mentioned, this is free publicity. This is the best advertising you can get. If nobody talks about you, nobody will know about you, and you won't get much business. Lawsuits should be a last resort; it should be used only if someone actually does harm to you. No need to make a quick buck through lawsuits. People file frivolous suits are "low lifes"
