    Copy Right Question?

    Hi,
    Not sure if the heading is right. Just want to find out. If we produce a portrait of a US sports star, celebrity etc. and than sell it, is there any implications in the US market assuming the portrait is not a copy of photo/promotional material that is deemed copy righted.

    I know here in Australia a person does not have any rights over their image as long as not inflamatory(?).

    Any responces would be appreciated.

    I believe the US laws are similar to Australian laws.

    If a 'cartoon' is created of said celebrity, no copyright implications are possible, as this is a 'work of art' and 'origanal' and not a 'photograph'

    Wabblehost is correct but you are selling the work. Most famous celebrities do have trademarks on themselves such as Elvis, Tom Cruise, and many others. Plain and simple they want a cut also. To be honest if you are only doing it as a small operations you are ok. But it will be hard to get into big retailers and distributors.
