air,

Please contact me at my office. You really need to speak with an attorney. Getting into the Adult Entertainment Business is a grey area in itself let alone getting into the "escort" business and you really need to protect yourself.
Also, you may need to comply with 2257 record keeping information and if your type of business requires you to do so and you fail to do it properly, you can and more than likely will be sentenced to jail time, the first charge being 5 years and 10 years for each subsequent.
Of course this also is dependent on whether or not you are in the U.S.
Please contact me at the number or email address below. Our office specializes in this area and I can start you out with some information that may be helpful to you in deciding if this business is right for you or not.

Some things you might need (not necessarily all inclusive):

1) Start a corporation

2) Get a model release form (so that you own the images)

3) Keep up with 18 USC 2257 records, which basically require you to have a copy of every model's ID and to list on all your marketing materials the name and address of the person who has those documents

Now, regarding the escort side, it's risky even if you call it "just companionship." If it's found that in reality (and despite how you describe it) every girl you list ends up sleeping with the customer for money, you might be held criminally liable as a pimp.

FYI - 2257 Laws REQUIRE you to keep your records stored digitally in an office setting and supervised for a minimum of 20 hours per week (during regular working hours). What is needed for 2257 compliance is the valid photo ID of the model/talent, a 2257 model release (which is what the Feds are really looking for in the way of releases) which has all of the model/talents information including all stage names and alias'.
You also need to know the laws within your state. Again, getting into the "escort" area is a very shady area and I once again suggest you call our office and make an appointment to speak to an attorney. CG410 is correct.
At the least, please contact me via email or send me a PM and I will get you started on some of the pertinent information in getting involved in the Adult Entertainment Business.

Lisa,

In the text of 18 USC 2257, all that is required is that you have a copy of the ID somewhere, you state on your products that all models are 18+ and where the custodian of records is, and that you allow the AG to inspect them upon request.

Where do you get the requirements that they be digital, babysat for 20+ hrs/wk, in an office, and contain any kind of model release form (not that you shouldn't have a model release form for your own purposes, but...)? Is there some sort of case law that mandates this?

Yes. The DOJ revised the law last year. PM me with your email address and I will gladly send you a copy of the entire guide. The new custodian of records came about because most smaller businesses could not only not afford to rent a small office space but in the event they work full time jobs cannot afford to pay someone to "supervise" them.
Again, PM me with your email and I will send you the complete guide. If you'd like, I can also send you the Guide to starting your own adult business that our office puts out to those who are considering the business.
