    Trademarks... Do I Really Need One?

    I'm really concerned (and confused) over the whole trademark issue. My company is currently developing a webiste (we'll call it wwwdot X dotcom] for simplicity), and we would like to trademark X. However, I hear that trademarking is state by state. Is this true? So in other words, to have a trademark recognized by all 50 states I have to trademark X in ALL 50 states??

    You do not need to register the trademark in each state that it is used. You register only with the state if the trademark is for intrastate commerce (all transactions within a single state boundary). By registering for a Federal trademark through the PTO you have trademark status in all 50 states, but also must be used in interstate commerce (some transactions must occur outside of the state in which the business entity exists and the Trademark holders/agents registered address) .
