    I am a little confused

I am in making of an auction website. I hired a designer and told him to use ebay to refer how it should turn out. They are the perfected auction site so, looking at their site as a guide in my mind was a smart choice. The top bar on my site looks similar to theirs. Its a bit darker and such. I am afraid now, if I will get in trouble in the future by ebay. What you guys think? I just need a few opinions. The designer insists that I cannot but he might be just being a bit lazy. Who knows?

If it is not much trouble, can someone take a quick look and compare. Please let me know. Be honest please

Thank you taking your time to read and stating your opinion.
    Everyone have a great day.

Just had a look and i stand to be corrected on this but to me it look like a standard turnkey script i bought one about 2 weeks back to develop which looks very similar but with the addition of a classified ad section and it cost me £2 or $4 including the domain name. OnLine Auctions

You should find out if ebay has trademarked that design...the page is very similar.

I have found this on ebays help section
    Trademark

I do not think I am breaking any ebay trademarks or anything in that sense.

It definitely looks a lot like an eBay clone to me, I think it would help a lot if you were to use a different colour scheme.

That is the color the auction software comes with. The top search bar is what I am worried about. That is the only thing I got my designer to work on.

A couple of questions on this one please,so what you are saying is you have a designer doing this site from scratch as i understand it and as he is building it he can change what ever colour you require can he not.Was this designer very expensive and did you have to spend a great amount designing it because i have just had a look on Ebay auction its self and there are loads of these scrips all setup for sale for about $10 So why would anyone spend a lot of money for what seem to me be a standard script i still cannot grasp that one.

The script they are selling on ebay requires a activation number. Once you generate it for a server, it no longer works for another. Unless they are transferring servers and everything else. To get another activation number, it cost the same. Check out phpauction.com You will understand what I am trying to say. (most on ebay for 10 dollars are the free ones you can get off the internet is phpauction gl.) Very useless for what I am trying to do.
