Does Constant Contact have rights to your contact list & any materials you post through them?

I am in the commercial finance field and was considering utlizing Constant Contact to help boost exposure to new business. An IT friend of mine informed me that any contacts I upload to their site and any material I develop or upload using Constant Contact becomes owned by them. As in, they have ownership to my contact lists, etc...and have direct access to my clients and may contact them for their own purposes.

Is this true? Is there a real danger in utilizing this service due to the possible exposure and acquisition of existing clients, etc...?

I work for Constant Contact and this is a common question we have. The short answer is, No, we would never email the contacts you upload to Constant Contact.

The long answer (which can be found on our site is):

Constant Contact's standard privacy policy is designed to protect people who subscribe to our customers' email lists. It is Constant Contact's aim to protect contacts from having their personal information used in a manner that they might find undesirable. Constant Contact strictly forbids the sharing, selling, and/or renting of contacts' information. In addition only you can use the email addresses that you load into your Constant Contact account. Constant Contact does not use these email addresses in any way, shape or form, other than to provide the service to you for your account.

No official email marketing service such as constantcontact.com, aweber, mailchimp etc can own your contact list. I use a lot of these services and I am quite certain they have no rights over your contact list.
