Good Idea to add my site, but is it legal?

To have music playing on your website do you have to have the rights to the song or some type of permission?

Also how do you add a music player to your site? I will not have music playing automaticly because I hate sites that do that, I usually have better music playing. :P But i want to have a play button somewhere on the screen so the visitor has the option to play recent mello alternative music playing but w/out lyrics.

You need permission from the the creator of the music. You could get a license so you don't have to get permission, but that would be major overkill for your situation.

Dang I thought it might of been legal because doesn't myspace allow you to put music on your space? (Im not fimiliar with myspace i just thought i saw a friend have it)

Yes, but with MySpace folks are usually doing this illegally. MySpace was originally created for bands to interact with their fans, so that is the thinking behind it - but now alot of folks include commercially available music, which, again, is illegal.

nah most myspace music is from songs that myspace licensed. there is a list. u can't just upload whatever you want.. I mean, u could embed a media player in myspace..but that is not what most people do.

Hmm, most folks I know who use MySpace take songs from their CDs, MP3 players, etc and use them that way - which is definitely illegal.

Well do you think I could work a deal with the artist who's song im trying to use? Such as once i get the traffic high and it started well do you think i could just email them and just ask for permission as long as i put their name and stuff on the website?

just a note,

it's not really illegal until someone sues you.

And musicians won't sue myspace folks because myspace bloggers are not putting their music up to make money from it.

But if you were to have their song up... and was financially benefiting from it, then you will hear from them.

I promise.

You could try that, but make sure you get permission before you use the song. As long as they agree, you would definitely be all set. Otherwise, they may to collect royalties from the past, which could add up to the millions of dollars. Or worse, they could bring a lawsuit.

So it's better to be safe than sorry. And I don't want to discourage you either - I am just trying to be sure you do not get burned with bad advice.

Yes, comicsfan98, it is illegal, at least in the United States and pretty much every other developed nation.

It does not matter whether you are using music to make money from it or not, if you are infringing on the rights of an intellecual property holder, they have legal grounds to bring a case against you.

Dwaltin, please take the more mature advice of this thread, and be sure you have permission to use the music before you actually use it.

comicsfan98, I believe an Ethics 101 course would be in order for you.

Alright thanks for the info guys, well if the site gets established well and off to a really great start I may think about send the artist an email asking them, also I if they allow me I could sell the album that the song is on on my site, benefits both of us.

Of course, and millions of users at Myspace are criminals. I also never advised him to use the music illegally. Please read my post again.

I was pointing out what is really happening in terms of how law is being practiced in business world. I think he already knows what is legal or not.

Have you heard any case where a musician sued a blogger at MySpace for having their music playing on the background?

Thank you for your suggestion on taking a wonderful course. How about I take that course from you? I would offer you a chill pill per hour for your effort.
