I was pointing out what is really happening in terms of how law is being practiced in business world. I think he already knows what is legal or not.
Have you heard any case where a musician sued a blogger at MySpace for having their music playing on the background?

Yes, millions of MySpace users are criminals - I am glad to see you are catching on.

Well I will just take alot of caution if i do happen to do this, such as contacting the bands and everything. However I do like the idea of getting a band that is not big yet, one of my good friends is trying to go to the top with his acoustic. Perhaps I could get him to record just a really cool melody with his guitar.

I don't think there is much chance of you getting in trouble for doing it, if it was me i wouldve just put it up straight away, so I congratulate you for asking here and being cautious about the whle thing.
BTW I dont know about everyone else, but I dont switch my speakers on when surfing the net. If they are Im surfing whilst listening to my itunes.

I'm with TSO on this. It seems to be alot of immature peopl eon this site ( nothing unexpected however) also not very business savvy. The statement of its not illegal until you get sued is how you end up doing time or have a lawsuit, i should know i got sued by the RIAA. Your best bet is to get everything set p in the first place and not worry about getting caught doing something illegal. If your site blows up real fast like myspace there will be competitors backtracking your site trying to find something wrong so they can bring you down. Its a cruel world out there but if your on top of your game you dont have to worry about anything.
Dwalt i think you could change around your scene her and instead of paying someone else for putting music up you could find smaller or local band that would pay you to play their music whilst displaying their name and charge a low fee. It would benifit both parties. just a quick thought.
