You need to check your governments trademark/copyright websites to learn which documents need to be filed and what you should do.

First check the trademark database, located here (if you live in the US). You can search their database of trademarks, both expired and existing. From there, if your name isn't taken, you should register it as a trademark. You can probably do it at the same site.

    Good luck!

in all honesty... do your trademark tests and all that... but if you can't find your name anywhere and your domain is available... just go for it... even if you look at other brands and bands... every-now and then when you get big enough... someone will challenge your name and you will either have to win the court case or change your name

    eg: tsubi changed to ksubi

Trademark the name, and copyright the designs.
