Yes you should be able to patent genetically engineered 'living' beings. After all the companies put a lot of money into the development.

The core issues is that the patent system in the united states is broken, and is in need of a complete overhaul.

are you kidding, So you can patent the changing of living things.... Ok, so let me remove your arm put a honda arm on you... and I think I could patent you...

That is what they are doing, they patent bio engineered products to patent so they can own them, they have in no way helped america, but they just want to own the seeds, and by owning the seeds you own the food. Its pretty F*d up

Um yes, if they find a way to put a honda on my arm they own the method of doing so, not me (they don't own the seed unless they grow them, just the methods to create it and as such nobody can create it without their permission).

If they develop a gene to make corn resistant to freezing, they put it in a corn seed they own that variety of corn.

This is the difference between capitalism and any of the governments Americans typically fear. Capitalism, in essence and in the short term, dictates you work in your best interest and developing better seeds to give away isn't a good idea for a company in a capitalist economy.

So go to wal-mart and buy a pack of seeds and grow your own. Use what you grow to get more seeds, and so on and so forth. Be careful, your unlikely to get true natural seeds so subsequent generations will be more prone to mutations.

These companies do not deny you access to seeds, only the ones they own.

As for them patenting any random seed that they didn't create, that's whats wrong with the USPTO.
