    Using your competitor's name in advertising?

    I am planning on getting business cards printed up to promote a new product of mine...This is hypothetical but let's imagine I am starting a new cola company.

    Is it legal that I user the competitors name printed on my Business card saying for example, "Better than Coke and Pepsi" ?

    You better have proof than it is better than Coke and Pepsi and on the advertisement should cite the source of your information.
    For example, Miller Lite will say 8 out of 10 people prefer Miller Lite over Bud Lite in a commercial, but they will also say it is a based on XYZ taste test.

    The generic line of Equate products available at Walmart comes to mind. Frequently, you'll see Equate brand XYZ with a little bit of text that says, "Compare to ABC National brand." However, they also usually list the information for ABC National brand on the packaging, stating something about who it is distributed by.

    There are better ways to promote than using business cards... and I wouldn't use the 'better than' line as who's to say it is... comparison charts would be fine as long as you know what you are comparing and why that would appeal to the target market... or even as mentioned above... having a consumer group sample unmarked products and then choose the one that they like best.

    How about using your competitors name in your card for location purposes, like next to NAPA Autoparts.

    you must prove your product that its is "Better than Coke and Pepsi", it also depends on the taste of your customer to determine which exactly is "better".
