    trademarks???

    so i wanted to know if someone could give us a little bit of info on trademark limitations. I know you cant really put a trademark on a common word but what if you put 2 things together like rusty and tree to get rustytree??? can you trademark that? i mean why not face...book has to have a trademark on that? Just need someone to explain this a little better please! Thanks in advance!


    OH YEAH is there a place online to look up existing trademarks free, easy and quickly. Would help me in with name choosing process.

    Yes, you can trademark something like RustyTree. If the generic words are unique when combined, you can trademark the new word.

    I have trademarked several things with the help of my lawyer. When she applies for the trademark she always requests that I provide her with the an example of how the trademark is going to be used; a screen snapshot, etc.....

    I trademarked ConsumerTreehouse.com and the logo for my site with no problem. Good Luck

    ok well what about if i dont have a logo i just have the name? can i just trademark the name and then the logo at a later date??

    as long as .....rustytree has a descriptive business purpose...

    Does not need to be a logo because you aren't using a logo...Show them how your going to use it

    You don't need a logo, you just need to show them how you are intending to use whatever you are wishing to trademark. I started the trademark process without my logo, once I had my logo complete I added it to my trademark. I also trademarked my sites logo. "Your Source For Unsolicited Product Reviews."

    So technically I have two separate trademarks for my site.

    FYI, you are asking for trouble by not including an indication that your name and slogan are trademarked. If you are not including the standard TM after your trademarked items, it will be significantly harder to enforce the trademark if someone attempts to use it. The court will be inclined to say that you didn't care enough to let anyone know that it was yours, so what's the problem with someone else using it for their gain. It would be likely that you would still win, but why go through the hassle?

    I paid, with legal fees, between $3500 and $4500. My lawyer has her own practice and works on her own so she is very, very knowledgeable. She is also a jack of all trades and has clients all around the world, I have used her for some of my property purchases, website contracts, selling of a business, trademarks, as well as two lawsuits and a wage claims suite that I have brought against individuals and former employers.

    She knows the legal game for sure.

    Since I use her and not a law firm the pricing might be different. She has told me that she has no overhead so her fees are very low compared to firms where multiple people work.

    The least offensive or instigating way I know to say this is that there are MANY less expensive yet equally, if not more, effective options than the attorney you used.

    Definatly payed too much, from memory it's about $300 to submitt then about $100 for each class or it could be the oppisite way. As soon as you engage a lawyer it will cost a fortune.

    Also don't forget to look into the madrid protocol.

    The Madrid Protocol will only arise if you intend to conduct business overseas in countries that abide by the Protocol. Even for an attorney, that is VERY high...ESPECIALLY for one that is a general practice attorney rather than an IP specialist.

    Just out of curiosity. Would he need to trademark variations of the name RustyTree? For example, Rusty Tree or RustyTrees?
