RecordLabel: Same name company exists

Basically I thought of a cool name for a record label and I want to register the business. According to my state of missouri I can register it. The other record label exists in south africa and is small yet profitable, but has the same name as my intended label. Is this just a forseeable legal battle? The other label is indie and on another continent? The name is awesome, what should i do guys? Is this legal?

The copyright laws for here and south africa are different. If you copyright it in the states before they do then you will be fine. If they already have is copyrighted in the states then it could be a problem.

Sure its legal as stated above...

But with the internet , when people search for you they will find both labels... and you say this label is already successful

Why in the WORLD would you want the same name as another label? Esp in music where thats important?

...even if they are in So Africa....online, they are next door.
