    Mobile phone gambling

    My current project is the possibility of setting up a mobile phone gambling service. Selling scratch cards, fruit machine games and more via the mobile phone. Any help would be appreciated, from partner to financier. Also help on gaming legislation in UK and USA would be great.

    There are games you can buy that are fruit machines but not for real money though - im not sure if there are ideas or proposals for this already but its a nice idea, and regarding legislation i suggest you talk to a lawyer.

    Hi High_life_UK

    Many gaming corporations are currently looking into the mobile phone business regarding Mobile gambling so from the start you will be up against fierce competition, anyway if you are seriously looking to enter this market here are some things you will have to do before you start.

    Here is some info for you regarding gaming machines (fruit) I assume it would be similar requirements whether its on-site, online or mobile phones

    - Under the Gaming Act 1968, it is illegal for anyone to regularly sell, supply or maintain a gaming machine unless they hold a section 27 certificate from the Gambling Commission.

    - The fee for a certificate is 7,000 pounds and the certificate is valid for five years, unless it is revoked beforehand. The renewal fee is 4,789 pounds.

    - Applicants need to complete and return three application forms: a business declaration, personal declaration, and an application for an enhanced disclosure. Applicants based in England and Wales should complete a Criminal Records Bureau enhanced disclosure form, while applicants based in Scotland should complete a Disclosure Scotland form. There is a fee of 36 pounds for the CRB application and 20 pounds for the Disclosure Scotland application. The fee for a disclosure application is payable in advance, but we do not request the fee for a Section 27 certificate until our enquiries have been completed and we have decided to grant a certificate.

    You mentioned scratch cards, this is a game of chance and you will find this is covered in the Lotteries and Amusements Act 1976.

    - Society lotteries can only be run for charitable, sporting or cultural purposes, not for private or commercial gain. The maximum price of a ticket in a society lottery can only be up to 2 pounds. Tickets in a society lottery cannot be sold by means of a machine.

    If you do manage to obtain the permits to run a private lottery, your ticket sales cannot exceed 250,000£ per annum and no profit is allowed to be made of ticket sales.
