So I recently launched my company which sells executive oilfield gifts, and I sent out a bunch of email to retailers who would be interested and got a response from one. I then setup a meeting to showcase the product and they were very interested, they wanted me to show them the rest of the collection that evening. I also left 2 models over lunch which generated some interest (or so they said).
The retail shop is a high end gallery for fine arts and other products and they are situated next to some the major oil corporations head office (Chevron, Shell, BP, ESSO). After discussing with them, they wanted me to do the following:
1) Raise the prices for my products (even on my own website)
2) Give them exclusivity to hold the products (meaning i cannot go to other retailers and sell)
Now, I do plan on getting some of my sales through individual end users, but my strategy for is to go after the retailers.
I told them I would draft up a counter offer in regards to the pricing and exclusiveness. Now I do want to do business with them because it will get my product more exposure, but I don't want to sacrifice everything.
What would you do? Also do I need a lawyer for this to draft up a general terms of agreement?
