I have no idea bro, but I believe if you created something clearly better then their would be no problem. Only if your idea mimicked his is when it wouldn't be ok.
are you sure? what about the multi touch pad, apple got sued because they were not the original who made the multi-touch pad. mmm. thats what im wondering
The way I look at it is it would be ok if you wanted to create something just like the iphone but say it had a built in lighter with it. If it looked and did exactly what the iphone does now and you could download exactly the same stuff as you can with the real iphone then that would be wrong. But if you couldn't and it had its own platform with new software and things then it would be ok unless you used the exact same branding technology to create the actual physical phone. Do you get where I'm going with this?
yes.. that's perfect i hope this is true because i have a pretty cool idea i mean its nothing special but maybe it be one day. i thought if the idea was patent then you cant create regardless, or you have to have the inventor say in it. but i understand what you are saying lets just hope i don't get sued lol
I am no expert it patent law, but I believe if you build upon the invention and it is better, than there is no problems. You just have to give credit to the original designer.

With a patent you can sell the right to manufacture.
This is also known as selling a license.
How old is the patent in question?
It could be expiring soon!
After the patent expires the invention is free game.
Another approach would be selling your improvement to the current patent holder. He might welcome a deal like that.
I recommend reading "Profit From Your Idea" by Richard Stim.
