    For fashion handbags designers.

    Hi all,

I need to know how the patents work just in the process to manufacture a handbag.

Basically what is the patent from a handbag?
is the patent the size the handbag will be?
or is it just a data for the machine that is gonna manufacture them?

    Thanks a lot

You really need to speak with an attorney. Some members may offer legal advice, some better than others (and that's a nice way of saying that there will be advice given by people who have no clue about the law that is just dead wrong), but do speak with an attorney before acting on any advice.

Thank u Jonathan but I don´t know why I have to talk before with an attorney?

I mean patent not to register a brand, the patent in the design of the handbag, is like a special measure that go to the machine is gonna manufacter de handbag.
Perhaps you are meaning in a law context.

You don't HAVE to do anything. However, a patent is a legal concept, created by the law, and for which attorneys spend years studying. Just like with other types of intellectual property, it IS possible to do things on your own. (For example, we are doing our own trademark and copyright registering, but only because my business partner have both taken the law track, as well as the business track. If we had not, we would definitely be consulting with an attorney.) However, by failing to consult with an attorney, you are taking a risk of overlooking and misinterpreting legal issues. Find an attorney who will give a free initial consultation (most do) and find out what issues exist.

When you're dealing with legal issues, the best advice is to NOT go at it alone, and to NOT take the advice of anyone here or anywhere else. Attorneys went to three years of law school for a reason.

Okay...besides the law issue here which Jonathan already covered. You are looking to patent your handbag. Do you know that unless you have your own "handbag police" to watch out for knockoff artists, chances are your patent will fail.

In Paris alone, I was approached by a Chinese lady who was willing to pay me money to go in Louis Vuitton store to purchase an original so they can do a knock off of it? Even though Louis Vuitton limits your purchases and with lots of money to send their own detectives...they can't even stop Asians from pirating their designs.

    Good luck with your patent.
