I do. They can be "considered" anything that you want them to be.
So it doesn't matter for tax purposes or anything like that?
It most certainly does matter. But there is no legal requirement that they be one or the other. I highly suggest you consult an attorney to learn the differences between them and ensure that your contracts are all in line. Otherwise, you'll likely run into big copyright issues.
