    Copyright Infringment?

    Hi all. I am writing another eguide. I have a question about my eguide name.

    My eguide is an ebay ebook. It is very original and nobody is offering what I do.

    Anyway, does anyone know what I have to do, in order to put ebay in my book name?

    I see most people do this; ebay(R) auction secrets

    But, is this all i have to do, or do I need permission from ebay?

    that's not a copyright issue

    that's a trademark issue

    essentially, ebay inc has a right to a reputation, and you are not allowed to interfere with that right by using the ebay trademark in a way which makes people think that ebay inc is in some way endorsing your ebook

    basically, you have to put in a disclaimer saying that "the authors and publishers of [ebookname] are not affiliated with ebay inc" i.e. you have to make sure that your conduct does not interfere with ebay's trademark rights...and to determine whether what you're doing is interference , you normally need to apply a number of tests

    want more explanations or sample clauses? I suggest wikipedia...but if you're really stuck, I'll post some stuff

    Sure please post. I am hearing mixed stories. I heard what you said. I have to use ebay (R) if I refer to them. And if I put

    eBay and the eBay logo are registered trademarks ...somewhere on the webbsite,title, and ebook.

    I cant use ss's or say I am a employee of ebay etc.....I get all that..


    The more info you can get the better a decision I can make Please add more

    Akula, i like your explanation but i would be kind of weary about wikipedia. There are a plethora of other good sites on the web to find information. The only thing about wikipedia is that the information can some times be unreliable figured that out the hard way when i pretty much bombed a project because of the wrong information.

    good point, but i'm not gonna link lay people to primary or secondary legal material. lay discussions are best referenced by lay links.
