    ConnectU vs Facebook, what do you think?

    For those who don't know...the founder of facebook is a programmer, he was retained by some kids at harvard to make a social networking site, instead, he took the code and launched his own site...now worth about $2bill and planning an IPO

    of course, he is now getting sued

    do you think Zuckerberg should pay them back for stealing their idea (and source code)?

    side note: all you creative thinkers out there, get your web developers to sign non compete agreements. that's where the the founders of connectu totally screwed up. they didn't get one signed, and so now, their cause of action is pretty sketchy ("copyright infringement, breach of actual or implied contract, misappropriation of trade secrets, breach of fiduciary duty, unjust enrichment, unfair business practices, intentional interference with prospective business advantage, breach of duty of good faith and fair dealing, fraud, and breach of confidence")

    i think he should be sued man....it wasnt his own idea anyway. But is very subjective since he wrote the code right? or did he not hmm

    I dont know how that will hold up in court, unless they can somehow prove that they actually had that conversation and that the information was exchanged. Hopefully they have an email or something to show the court, otherwise they dont have much of a chance.

    I dont know much about web based business but maybe they had a copy write on the code? or something else that they can prove by putting the two next to one another

    the thing that kills me is that it was kids in Harvard, you would think they would be smart enough to do NCA.

    Technically if they didnt agree that they owned the source code the coder owns the code and he can do anything he wishes with it.

    Non-Competes are kind of a joke anyways - I'd like to see some stats on how often they actually hold up in court. Most states are Right To Work states, correct? I think the Non-Competes are more of a scare tactic than anything.
