    can i be sued if...

...if i tell my supplier to sue our company i'm currently working for (for whatever reasons), so that my company has to file bankruptcy...

so that i can buy the company or the company's product for little money?

    so this legal?

sorry if this is a stupid question...

how do you even plan to go about telling the supplier to sue the company. a simple "can you guys sue my company" wont do.

    no, probably not legal

    a) the supplier would need a cause of action to file the suit, which can't be frivolous...or the person who is launching could be in contempt of court and be fined

    b) your company would need to file for bankruptcy, which only happens if the creditors fail in contesting such a resolution...and the directors of your company are not allowed to make this resolution in bad faith

overall, if you're in US, the corporate regulator would discipline your company's directors if they fail to properly exercise their duties to their shareholders...i.e. do anything which undermines the value of the company

it's all to do with corporate law..and then you get the anti racketeering legislation as well...essentially, what you're talking about is the sort of thing done by the mafia when they wanna take over someone else's business...it's criminal

no i do not hate the boss...its just that he's never around, spending all the company's money, jetting around the world with his girlfriend...long story short, he doesn't work!

right up to the point, where salaries are being paid out late, creditor bills not being paid, meetings not being attended...the list goes on...

so it seemed to me like a good opportunity to buy out the company...

but if its illegal, then i cant be bothered...i guess

i'm sure if all those things that you have listed accrue over a period of time, he will need to file for bankruptcy if he's unable to pay off his bills, then you can swoop in and buy

or..in case you don't wanna wait..you can put in a bid for an mbo

sounds like the boss is keen for an exit..provided that he's the majority shareholder, that is....and if not, then he may be playing his own little embezzlement game on the owners of the business
