    How to Patent a Technology Security Product

    We have fully developed a line of security products that allow parents to filter whom is able to text(sms), email or phone their child. If you try to contact their child and are not on the parents safe list then the parent/guardian receives the call first and can either block it, delete it all together or forward it onto to the child. We also have a GPS element that allows parents to create a "safe zone"for their yougn child, so if this child steps out of the "safe zone" the parent is alerted immediately and can see where their child is either via their cell phone or computer.

    These products are developed and internationally trademarked. The problem we are running into is that we do not have a patent.We are trying to sell the assignment of the tech IPs to a larger firm who can take it to where it needs to go --we do not have the funds or proper management skills in place to do it ourselves - but every potential buyers asks us about a patent and from our initial research we found that the time to have this processed (up to 7 years) and the funds to complete it are too high for us.

    Is there any way for us to get a patent in a month? or if not, is it possible for someone to outright buy the assignment to the tech IPs without it? The product is solid and in much need with cyberbullying on the rise and teenage/young adult suicide on the rise as well because of cyberbullying. This also technology will also block predators from communicating with your child as you, the parent/guardian, are the front line for receiving "unwanted, unsafe" communications being sent to your child.

    what about a provisional application?
    these are the provisional rights that you get:
    35 U.S.C. 154 Contents and term of patent; provisional rights.

    (d) PROVISIONAL RIGHTS.-
    (1) IN GENERAL.- In addition to other rights provided by this section, a patent shall include the right to obtain a reasonable royalty from any person who, during the period beginning on the date of publication of the application for such patent under section 122(b), or in the case of an international application filed under the treaty defined in section 351(a) designating the United States under Article 21(2)(a) of such treaty, the date of publication of the application, and ending on the date the patent is issued-

    (A) (i) makes, uses, offers for sale, or sells in the United States the invention as claimed in the published patent application or imports such an invention into the United States

    The advantages of a provisional patent application are:
    ease of preparation,
    lower cost, and
    the ability to use the term "patent pending", which can only be legally used when a patent application has been filed, and which may have significant marketing advantages.[10]
    As of September 8, 2010 the USPTO small-entity filing fee is $110 for provisional patent applications having 100 or fewer pages of specification and drawings and complexity involved for a provisional patent on the part of both the applicant and the USPTO is generally much less than that of a non-provisional patent application. Thus, it is possible to file a provisional patent application more quickly and cheaply than a non-provisional patent application.

    Akula: Thank you for that sound piece of advice. We will be looking into that on Monday. If I may, I would also like to ask you if you know of legitimate "agents" (for lack of a better term) that could aid us in selling our product to a much larger entity who could take it to market and manage it? We have had so many scams and con artists take money from us telling us that they could put our product line in front of many potential buyers and then they take our money and run. We do not have the in-house management skill set or funds to build a company around this, however we would like to sell it for a cash/equity deal but would like a professional to handle the sale for us --similar as to how one would hire a real estate agent to sell ones home.

    no...not really...i don't know anyone like that and i doubt any kinds of sales agents might be able to help you, as you have nothing to sell

    let me re-frame your situation and tell you how to make things work. everything is very simple..the golden rule in software commercialisation is traction traction traction;

    1) your team needs to be able to code a demo and find your selves a bunch of beta customers who'll pay for the product. before this happens, there is no point talking to you. you have nothing to offer.

    2) it's only after you show traction that there can be any talk of you guys assigning IP to a larger corporate, or of your company being acquired

    3) as far as I know, in software, the number of successful, uncommercilalised patent assignment/licensing deals done this year is pretty much 0 across the whole country. it's not by accident either. it rarely makes commercial sense for anyone to acquire greenfields IP.

    4) likewise, the number of acquisitions where the target was pre revenue, pre launch is close to zero. these kinds of acqusions only happen under limited circumnstances which are not relevant to your opportunity.

    5) on a gut level, my advice to you is commercilise this software opportunity you have in the same way that all other software opportunities get coommercilised in the valley; put a team together, code the damn thing, start showing it to people, get a bunch of customers, release v2.0 and hope that you get acquired.

    6) your software is basically an application that alters call/sms/email forwarding options on iphones/other smartphones. this is not deep tech. you don't need patents for this. what you need is to go on rentacoder.com and get some guy to code this iphone app for you for $800 so that you can start selling it.

    7) if you ignore this advice and get into a position where you "need a patent so that you can licence it to someone blah blah"...well then, you don't understand software and you are gonna be ignoring the best practice principles of how software gets commercialised (keep things lean, release early, release often). eventually, you will fail after a lot of wasted money, heartache, youth and energy...it happens all the time.

    you will fail because you will either get tired, or because some other founder will take the right approach and quickly release a nice lightweight iphone app that parents can load on their kid's phones to change their call/email/sms forwarding options....it's not a hard thing to code. the basic version of the app will be free, the premium upgrade will be $20 bucks..the app will go viral and make the founder a millionaire..or it will fail, and the founder will just lose their $800, buy himself a beer and think up some other app.

    that's the right way to do things. do the right thing. forget about all these patents and licencing nonsense. it's all bullshit. you wanna be wealthy and successful? put everything down. go log on at rentacoder. in a month's time you'll be selling this app all over the world.

    It is functional and fully coded and we do have a demo. It took us 2 years to do all the coding and it cost more than $800 to develop it. However, we will try to sell it online and see what happens. I do appreciate your advice and thank you again.

    BTW: You have given the essence of your product on this public forum. I STRONGLY suggest you get your provisional patent done TODAY. I am sure you know the 2 CalTech students who got a provisional on what we know as Google Street View?? They are in for multiple millions because they have demonstrated that Google copied their idea they spent $110 protecting.     Our product is fully built and operational -we do not require anyone to build it. We had a team of 10 engineers, programmers and security experts build it --over the past 2 years. It is ready to sell and go today. We are not getting a patent at this time but we are looking for a partner to help us get it out to market. If you know of anyone legitimate that provides this service, please let us know. Thanks
