I'm confused. I went to talk to a volunteer lawyer, he said legally you should, but not everyone is doing it and I call the state finance department, the guy said you only charge the tax based on the shipping address. So, who should I listen to ?

Try also asking a CPA, I would go with charging tax only for the in-state purchases.

Contact your state taxing authority. They should be able to answer your question in just a couple minutes.
