However, the customer ordered items at his employers business, the cc#s used belonged to customers of that business..  And this is not the first breach they have experienced.  So i see a high level of liability just on behalf of the employer themselves.  <br />
<br />
I have spoken to the owner of that company, who was an absolute prick to me.  He told me to contact his lawyer, but wouldnt give me that info.  He has business insurance i trust, i dont know why he would make such a big deal about filing this under this BO insurance policy.  <br />
<br />
Maybe someone at a NJ firm would be interested in picking this up.  Yeah i would like my $2k, but you can pretty much have the rest.</div>

This is an e-commerce business, there is no place to be other than their own homes. Thus, I don't see the point in classifying people as employees if they're in no risk of on-the-job injury. But, I digress...<br />
<br />
Business Background;<br />
-S.M.L.L.C. in New Jersey<br />
<br />
-This is a Home-Based Business. As such, the &quot;main office&quot; is my own room. :)<br />
<br />
-Business is conducted almost entirely over the internet<br />
          A. Workers work from their home using their own supplies. I'll probably supply several quick-books to them though.<br />
          B. Starting out, I'll be using an Accountant, a Marketer, a Website Programmer, and an Order Processor(s), all of whom are my personal friends. Minus the Programmer, everyone will be solely with my company, as this will be their starting point into their new career. (First time Accounting for a Business / First time Marketing/Etc)<br />
<br />
-All are paid on a commission/piece rate payment scheme depending on orders processed/monthly profits respectfully.<br />
<br />
-So long as the end-result works out, their methods I don't care much for. However, I will make suggestions on how to carry it out and when it should be done/when to report to me.<br />
<br />
-There isn't really a work-schedule. The amount of &quot;work&quot; is determined by the amount of sales we do per day. If we have many orders, the order processor will be quite busy, as opposed to a low order day. Our Marketer will be looking at sales on a day to day basis and forming strategies on their own. I'll make suggestions, of course. Just to give you a few simple example.<br />
<br />
-Minus the order processor who gets paid, per order processed, at a fixed rate on my jurisdiction, their pay will be a certain % of profits gained per month.<br />
<br />
It seems that everyone has aspects of both. I really don't want to file an SS-8 form, since it may take more than six months, but, if no solid answer is found here, I shall have no other choice.<br />
<br />
So, with that said, what say you in your professional opinion?<br />

			<content:encoded><![CDATA[<div>Hello everyone, I am 21 years old young entrepreneur and got 2 investors to put up money for my concert. I am suing 3 national recording artists from a concert back in August 2008. They all showed up like 5 hours late causing my company a $90k show. We hired a lawyer about 3 weeks after the event occurred to try get matters sorted out with, maybe a settlement or go to trial. When hiring him, he said that he was going to try get a settlement before trying to go to court to save time and money. Its now over a year later, we haven't stepped foot in a court room or nothing. And why would he try file papers to the court over a year after they weren't looking to settle, shouldn't that be days after they weren't looking to settle? Anyway, its over a year now and that should take that long to get a court date. When calling our lawyer, he comes up with these excuses on why its taking so long, giving us BS stories,and giving us the run around. Its hard to contact him, he returns our calls when he feels, his voicemail is always full, doesn't answer emails, doesn't gives us updates haven't heard from him in over a month. From the time that we hired him, he sent out requests for settlement agreements and they didn't want to. Its over a year ago and we still are at square one. Last time we talked, which was almost two months now, he claimed that he sent out some letters taking them to court, that was months ago and 2010 August will make two years and nothing has happened. Should we report him to the Bar Association and try to get our money back with this coward as well, what should we do?</div>

I'm NOT looking to form any corporation or elaborate type of business setup. I need to know if this can be done with a DBA/Sole proprietorship.<br />
<br />
So, here we go: I own 100% of the business (DBA). I want to give this person a percentage of my business based on how many new clients he obtains (ie:10 clients = 4% equity, 20 clients = 10% equity). What exactly does equity mean in this context?<br />
<br />
If the business brings in $10k and he has 20% equity in the business, how is this money divided? What is a 'normal' way of doing this type of arrangement.<br />
